As GÜNCEL YAZILIM, we have prepared this Personal Data Processing Disclosure Statement (the "Disclosure Statement") in our capacity as data controller, within the scope of Article 10 of the Turkish Personal Data Protection Law (KVKK No. 6698) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

In addition, detailed information about the cookies used when you visit our website, mobile site and/or mobile application is set out in our Cookie Policy. The personal data processed through these is explained in this Disclosure Statement.

The Disclosure Statement takes effect on the date it is published by GÜNCEL YAZILIM. GÜNCEL YAZILIM may amend the Disclosure Statement at any time where necessary. Any amendments take effect immediately upon publication of the Disclosure Statement.

Within the scope of this Disclosure Statement, Güncel Yazılım processes the following categories of your personal data:

• Identity information: name, surname, T.C. identity number, date of birth
• Contact information: phone number, email address, address
• Customer transaction information: order details, invoice details, contract details
• Legal proceedings information: correspondence with judicial authorities, case file details
• Transaction security information: IP address, log records, password and passphrase details
• Marketing information: purchase history, survey data, cookie records
• Visual and audio records: photographs, camera recordings

Your personal data is processed for the following purposes in accordance with Articles 5 and 6 of the KVKK:

• Providing products and services and managing customer relations
• Fulfilling contractual obligations
• Carrying out invoicing, collection and accounting processes
• Planning and managing information security processes
• Fulfilling obligations required by legal regulations
• Planning, developing and improving business activities
• Carrying out human resources processes
• Ensuring physical security (camera recording, etc.)
• Providing information to authorised persons, institutions and organisations

In order to achieve the purposes stated above, your personal data may be transferred to authorised public institutions and organisations, our business partners, suppliers, shareholders, private-law legal entities authorised by law, and other third parties, within the framework of the personal data processing conditions and purposes set out in Articles 8 and 9 of the KVKK.

Your personal data is collected by both automated and non-automated means through the website, mobile applications, email, telephone, face-to-face meetings, contracts, application forms, fairs and events, social media and within the framework of legal obligations.

This data is processed on the basis of the following legal grounds set out in Articles 5 and 6 of the KVKK:

• Being expressly provided for by law
• Being directly related to the conclusion or performance of a contract
• Being mandatory for the data controller to fulfil its legal obligation
• Being mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject
• The existence of the explicit consent of the data subject

Your personal data is retained for the periods required by the purposes of processing and for the statutory limitation periods stipulated in the relevant legislation. After these periods expire, your personal data is deleted, destroyed or anonymised in accordance with the GÜNCEL YAZILIM Personal Data Retention and Destruction Policy.

Pursuant to Article 11 of the KVKK, by applying to the data controller you have the right to:

• Learn whether your personal data is being processed
• Request information if your personal data has been processed
• Learn the purpose of processing and whether the data is used in line with that purpose
• Know the third parties to whom the data is transferred, whether domestically or abroad
• Request correction if it has been processed incompletely or inaccurately
• Request its erasure or destruction within the conditions set out in Article 7 of the KVKK
• Request that correction, erasure and destruction operations be notified to third parties to whom the data has been transferred
• Object to an outcome arising against you due to the analysis of the processed data exclusively through automated systems
• Claim compensation for damages incurred due to unlawful processing of the data

To exercise the rights set out above, you may apply by completing the KVKK Application Form.

You may submit your requests regarding the rights set out above through the following methods:

• Written application: You may apply in person, through a notary or by registered return-receipt mail, together with documents verifying your identity, to the address Üçevler Mah. Üçevler Cad. No:9 Nilüfer / Bursa.
• Email: [email protected] by sending an application form signed with a secure electronic signature
• KEP: Through your registered electronic mail (KEP) address

Pursuant to Article 13 of the KVKK, your applications will be concluded free of charge within thirty days at the latest. If the process requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.
